This is a limited warranty. It covers Blue Best's installation work on the heating and cooling equipment listed on your invoice. It is given at no charge with your installation. Keep it with your invoice.
1. Who is covered
This warranty covers you, the purchaser named on the invoice, and any later owner of the home during the warranty period. If you sell the home, the new owner keeps this warranty by calling or emailing us within 30 days of closing and giving us the new owner's name and contact information.
2. What is covered
Two things. First, the labor to replace any part of the heating and cooling equipment listed on your invoice that fails during the warranty period: for example, a furnace, air handler, air conditioner, or heat pump. Second, our workmanship in installing that equipment, such as refrigerant line connections and charge, electrical connections we made, condensate drain connections, the transitions and connections between the equipment and your existing ductwork, thermostat wiring, and the mounting or setting of the equipment. Accessories we install with the system, such as a thermostat, humidifier, air cleaner, or new duct run, are covered by this warranty for the same one year.
This warranty covers labor only. The equipment and its parts are covered by the manufacturer's warranty, described in section 6; this warranty does not supply parts.
3. How long it lasts
One year from the installation completion date shown on your invoice.
If you join a Blue Best maintenance membership, the labor coverage on this installation can run longer while your membership stays active, up to the limit of your plan. The extension is a benefit of the membership and is governed by the Blue Best Membership Terms, not by this document. This document is the warranty you have whether or not you ever join.
4. What we will do
If, during the warranty period, a part of the equipment fails, we will return, diagnose the failure, and replace the part at no charge to you for labor, trip, or diagnosis. The part comes from the manufacturer under its warranty. If the manufacturer does not cover the part, we tell you its price before we replace it, and you pay for the part only; the labor stays at no charge. If part of our installation work fails or does not perform because of a defect in our workmanship, we will return and correct the work at no charge to you for labor, trip, or diagnosis. We decide how to correct it: by adjusting, repairing, or redoing the work. If a part fails because of a defect in our workmanship and the manufacturer declines to cover it for that reason, we supply the part as well as the labor.
5. What is not covered
This warranty does not cover:
- the cost of the equipment itself or of any part of it: parts are covered by the manufacturer's warranty, not by this warranty, which covers the labor to replace them;
- equipment or work we did not install or perform;
- failures or damage from outside causes, such as power surges, lightning, fire, flood, water or freeze damage, pests, or acts of nature;
- failures caused by work on the equipment by anyone other than Blue Best after our installation, whether another contractor or you, other than routine upkeep such as changing a filter or keeping the outdoor unit clear;
- failures caused by lack of maintenance, misuse, or operating the equipment outside the manufacturer's instructions;
- consumables such as filters, pads, batteries, and refrigerant, including refrigerant lost through a part failure the manufacturer covers;
- cosmetic damage, and damage to ductwork, wiring, plumbing, or structures we did not install or modify;
- failures from conditions in the home that pre-date our work, such as undersized electrical service, poor drainage, or inadequate ductwork, unless our installation was meant to correct them;
- routine maintenance, tune-ups, and adjustments that are not the replacement of a failed part or the correction of a workmanship defect.
Having another company, or you, service or repair the equipment does not by itself end this warranty. What this warranty does not cover is a failure that the work caused.
6. The manufacturer's parts warranty
The manufacturer warrants the equipment and its parts under its own terms, for its own period, which depends on the brand and model and on registration. We register your equipment with the manufacturer for you after installation. The manufacturer's warranty certificate or registration confirmation states what it covers; keep it with this document.
If a major component, such as a compressor or a heat exchanger, fails repeatedly within the manufacturer's warranty period, we will pursue a replacement from the manufacturer on your behalf rather than repair the same part again. What the manufacturer provides is governed by the manufacturer's warranty.
7. Your first year of the Safety Plan
If you purchased a complete system, meaning a furnace and an air conditioner purchased from us and installed at the same time, your installation includes the first year of the Blue Best Safety Plan at no added cost. The Safety Plan's benefits, and how to upgrade it, are set out in the Blue Best Membership Terms, which you receive with your enrollment confirmation.
8. How to get warranty service
- Call 801-801-BEST (2378) or email info@bluebest.com. Tell us the address and describe the problem.
- Have your invoice number or installation date ready. If you are a later owner, tell us when you bought the home.
- We schedule a visit. Warranty work is performed by Blue Best technicians.
- If the problem is a failed part or a workmanship defect, there is no charge for labor, trip, or diagnosis. For a failed part, we will attempt to handle the part claim under the manufacturer's warranty; if the manufacturer does not cover the part, we give you its price before we replace it. If the problem is something this warranty does not cover, we tell you before any chargeable work and give you a written price.
Blue Best does not force you to use an informal dispute settlement program. If a question about this warranty or anything else comes up, call us first; most are resolved with one conversation.
9. Limits
Any implied warranty on the equipment, including any implied warranty of merchantability or fitness for a particular purpose, is limited in duration to the one-year term of this warranty. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
To the extent Utah law permits, Blue Best is not responsible under this warranty for incidental or consequential losses, such as spoiled food, lost time, or lodging. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
10. Governing law
Utah law governs this warranty. Any court case must be brought in the state courts sitting in Davis County, Utah, or in the United States District Court for the District of Utah.
